Purchasing Class 3 Firearms
Silencers, Machine Guns, SBR’s, SBS’s and AOW’s

Unfortunately, much of what you have heard about owning a Class 3 firearm is probably not true! The following was put together to help you understand what Class 3 firearms are and how the buying process works at Spyder Arms. While Spyder Arms can not transfer a class 3 firearm directly to a resident of a state other than Kentucky, we can sell to residents of other states, and then transfer to a dealer in your state who can transfer the item to you. Spyder Arms also sells directly to law enforcement agencies throughout the United States.

Basic Class 3 “Individual” Ownership Requirements:

  1. Be a US Citizen at least 21 years old.
  2. Be of sane mind
  3. Not an abuser of drugs or alcohol
  4. Have never been convicted of a felony
  5. Pay a $200.00 Federal Transfer Tax on each firearm purchased.(this is a one time fee. NOT a yearly fee. It is paid each time you purchases a class 3 firearm.
  6. Fill out a BATFE form 4 as well as a Certification of Compliance form certifying that you are a US citizen.( Spyder Arms fills out all of this paper work for you in order to make your buying experience easier. All you will have to do is review the forms and sign them.)

In 1934 congress passed the National Firearms Act. This act required the registration of and the excise tax on, certain types of firearms. The tax was set for most types of registered firearms at $200.00. This was very expensive in 1934, especially when the average cost of a firearm was $10 to $45. The good news is its still $200.00, which isn’t nearly as painful these days.

Class 3 Purchasing Process for an Individual

Step 1:
Pick out the class 3 firearm that you wish to purchase. If we do not have the item in stock we can get it. Just ask. You will then need to pay for the item up front. NOTE: We do not allow layaway on class 3 items all items must be paid for in full to continue the process. We will then get a copy of your ID and start the paperwork.

Spyder Arms will fill out the ATF Form 4 for you as well as the certification of compliance form( this is a form that basically states you are who you say you are).

Step 2:
Get two 2″ X 2″ color passport photographs. Attach one to the reverse side of each of the two copies of the Bureau of Alcohol, Tobacco and Firearms (BATF) Form 4 (Spyder Arms supplied). These photos typically cost $5 to $10 and are commonly done at places like Kinkos and Walgreens. We will give you the forms to take to your county Sheriff or chief law enforcement. They will fingerprint you. Once these have been done it is time to get the Chief Law Enforcement Officer in your county to sign these forms. Once he has signed them pick them up and bring them back to us in order to start the next step.

Step 3:
This is the long one. We will need a $200.00 check from you made payable to the BATFE. We will send all of your paperwork along with the check to the B.A.T.F.E. Now its wait time. The ATF only has 9 examiners for the entire US. With the increasing popularity of class 3 firearms they do get backed up with all the forms to approve. We can not give you a definite time on this. We generally tell everyone 60-120 days for approval time.

Step 4:
Once we receive your approved paperwork back and yes it does come back to us. We will call you and you will come by the store fill out a standard 4473 form and we will then give you your new toy. You will need to keep the original approved form 4 in a safe place. Make copies of both sides and always keep a copy of this form with the class 3 item. ALWAYS……

Class 3 Purchasing Process with a Trust

We highly recommend purchasing class 3 items through a Trust. Purchasing this way eliminates some of the steps in the purchasing process that you would normally do as a individual. With a trust you do not have to be fingerprinted or have your photo ID sent in with the form 4. Also you do not have to have the Chief Law Enforcement Officer’s signature. This also seems to speed up the approval process.

There is no fingerprinting,photo’s or having to get the CLEO signature when filing a Form 4 with a Trust. We will need a $200.00 check from you made payable to the BATFE. We will send all of your paperwork along with the check to the B.A.T.F.E. Now its wait time. The ATF only has 9 examiners for the entire US. While You Wait

While you are waiting for your Form 4 to return you get one hour of range time to use your NFA item. You must call and schedule an appointment. You are also responsible for the cleaning of the item. We can clean it for a charge. The wait for the Form 4 can sometimes take up to 9 months. But at least you can use it once a month while you wait for free.
